The Foundation may, for example, serve as a substitute for a will, avoiding probate THEREBY legally. In this respect it is similar to a ?living will.?

    It can isolate a portion of very Effectively your estate and succession dictating the management of specific assets. Needless to say this is very important for international assets that may not easily be brought within the scope of a traditional last will and testament.     The only exception to this rule is that creditors have a right to challenge a Panamanian foundation within a period of 3 years from the date the assets being claimed are given to the foundation. It?s important to note that this period runs from the date that the assets went into the foundation, not from the date the Foundation was registered.

    The Foundation?s financial affairs are nobody?s business but its own, and it should be up to you to decide who to tell about the existence of the Foundation.     Put simply, this means that you should open a bank account where most of the Foundation?s assets will be held outside Panama.     Autism rates up due to wider screening, better diagnosis, CDC says ...

    Autism cases are on the rise again, largely due to wider screening and better diagnosis, federal health officials said Thursday. The rate of U.S. cases of autism and related disorders rose to about 1 in 88 children. The previous estimate was 1 in 110.

    The new figure is from the latest in a series of studies that have been steadily increasing the government's autism estimate. This new number means autism is nearly twice as common as officials said it was only five years ago, and likely affects roughly 1 million U.S. children and teens.

    Health officials attribute the increase largely to better recognition of cases, through wide screening and better diagnosis. But the search for the cause of autism is really only beginning, and officials acknowledge that other factors may be helping to drive up the numbers.

    "We're not quite sure the reasons for the increase," said Coleen Boyle of the Centers for Disease Control and Prevention.

    Autism is diagnosed by making judgments about a child's behavior; there are no blood or biologic tests. For decades, the diagnosis was given only to kids with severe language and social impairments and unusual, repetitious behaviors. The definition of autism has gradually expanded, and "autism" is now shorthand for a group of milder, related conditions, including Asperger's syndrome. Meanwhile, there's been an explosion in autism-related treatment and services for children.

    As in the past, advocacy groups seized on the new numbers as further evidence that autism research and services should get greater emphasis. The new figures indicate "a public health emergency that demands immediate attention," said Geraldine Dawson, chief science officer for the advocacy group Autism Speaks.

    The CDC study released Thursday is considered the most comprehensive U.S. investigation of autism prevalence to date. Researcher gathered data from areas in 14 states ? Alabama, Arizona, Arkansas, Colorado, Florida, Georgia, Maryland, Missouri, New Jersey, North Carolina, Pennsylvania, South Carolina, Utah and Wisconsin.

    They looked specifically at 8-year-old children because most autism is diagnosed by that age. They checked health and school records to see which children met the criteria for autism, even if they hadn't been formally diagnosed. Then, the researchers calculated how common autism was in each place and overall.

    An earlier report based on 2002 findings estimated that about 1 in 150 children that age had autism or a related disorder such as Asperger's. After seeing 2006 data, the figure was revised to about 1 in 110. The estimate released Thursday, based on 2008 data, is 1 in 88.

    The study also found that autism disorders were almost five times more common in boys. And that an increasingly large proportion of children with autism have IQs of 85 or higher ? a finding that contradicts a past assumption that most autistic kids had IQs of 70 or lower.

    Also, higher autism rates were found in some places than others. For example in Utah, as many as 1 in 47 of the 8-year-olds had an autism spectrum disorder. In New Jersey, 1 in 49 did.

    Alabama was at the other end the scale, with only about 1 in 210 identified as autistic. The difference was attributed to less information out of Alabama. Researchers were not able to access school information in that state and a few others, and as a result believe they have a less complete picture.

    That's a reasonable explanation, said Zachary Warren, director of an autism treatment and research institute at Vanderbilt University.

    "How you go looking for something is going to affect what you find," he said.

    In the early 1990s, only a few out of every 10,000 children were diagnosed with the condition, based on some small studies in individual states or cities. But the numbers began to change dramatically after 2000, when Congress directed federal health officials to do more autism research, and CDC started the larger study to see how common autism is.

    CDC is also studying the cause of autism, which has remained a mystery.

    Genetics is believed to play a role. Some parents and others have believed childhood vaccines trigger autism, even though many studies have not found a connection.

    CDC researchers are looking at other possible factors, including illnesses that mothers had while they were pregnant with children who later were diagnosed as autistic. The researchers also are looking into medications that the pregnant women took and those given to their children took when they were young. The first results of that study are expected next year.

    'Clare's Law'- A change for the better for victims of domestic violence ...

    In October 2008, Clare Wood ended her relationship with George Appleton. Her rejection sparked a campaign of abuse, resulting in her horrific murder four months later. Appleton had a history of violence against women, including harassment, threats and kidnapping a former girlfriend at knifepoint.

    Despite a number of complaints to the police, resulting in a panic button being fitted in her home, this was not enough to save Clare. Her murder made clear that the treatment of domestic crime requires improvement. This led to a government proposal, named ?Clare?s Law?, enabling the police to disclose information to partners of those with histories of domestic violence.

    The pilot scheme, announced on 5th March 2012, will begin this summer. It follows a government consultation published in October 2011 which investigated whether a national disclosure scheme could improve the safety of people in relationships with previous offenders. The initial consultation raised important issues, such as how much information should be released and in which circumstances, and how malicious requests will be avoided. The government seeks to address these matters during the scheme?s trial.

    The pilot is testing two processes for disclosing information about a partner?s violent history; the first is triggered by a query from a member of the public (?The Right To Ask?); the second is where police disclose information in order to protect a potential victim (?The Right To Know?). Taking into account the amount of government and police time, and taxpayers? money spent on this issue, it is important to consider the implications of this scheme.

    Two people are killed by their partner each week in England and Wales; domestic violence is the cause of nearly 40 per cent of all female[1] UK homicides[2]. Evidently, government attention in this area is required, but is Clare?s Law the answer to reducing these figures? Refuge, one of the UK?s longest running domestic violence charities does not think so. The charity has criticised the proposed disclosure laws as ?reactive rather than proactive?.

    The theory behind the Government?s scheme is that if someone told that their partner has a history of domestic violence, they can then make an informed decision whether to continue with the relationship. This, however, raises many problems; if, like Clare Wood, a woman had no previous indication of her partner?s violent behaviour, then she would be unlikely to make an enquiry. Also, it is extremely doubtful that the scheme anticipates all those embarking on a new romance to carry out a police background check ? it is simply unrealistic and doesn?t reflect reality.

    Further, it is often on ending the relationship that people turn violent, as was the case with Wood and Appleton. Considering this, what is a woman to do when burdened with the information of her partner?s history? Many in such relationships stay with their partners out of fear for what would happen should they leave. Others might not leave because of love and belief that their partner can change. Would a woman be blamed for not leaving her partner when informed of his violent past?

    The proposed ?Right To Know? process means police will inform potential victims of domestic violence. Statistics show that 44 per cent of victims are involved in more than one incident[3], so certainly many victims are already aware of what their partners are capable of, without being informed by the police. Knowing that their partners terrorised others before them would provide little solace.

    Additionally, how would the police determine who they should inform? Appleton trawled social networking sites looking for his women. Are the police to follow these men from relationship to relationship, or message all their Facebook friends issuing warnings; for surely any one of them could be his potential victim. If a woman was able to escape an abusive relationship as a result of police disclosure, the perpetrator would simply be able to move onto his next victim. The problem is thereby displaced rather than prevented.

    The police can only inform on the basis of information they have available: the details of those previously convicted. Considering that less than 40 per cent of domestic violence cases are reported to the police, a minor proportion of offenders will have police records, making it extremely unlikely for those making enquiries under ?The Right To Know? to obtain accurate information.

    Having considered the implications of the proposed scheme, I think the most important thing is the way in which the police handle the disclosures. Potentially life-changing and life-threatening information is dangerous if unaccompanied by police support and intervention. Because the majority of cases go unreported, police time would be better spent conducting thorough investigations into allegations of abuse and monitoring those with troublesome histories. In a less than ideal world where prevention is impossible, protection should be key.

    (AP) ? A Canadian man testified Friday that he paid $105,000 (?80,000) to an Israeli citizen in 2008 to organize a kidney transplant in a Kosovo clinic allegedly used by an international organ trafficking network for dozens of illegal operations.

    Raul Fain, 66, of Toronto, told an EU-run panel of three judges that he sought foreign organ donors after doctors told him he could wait up to 12 years for such an operation in Canada.

    Fain testified from Canada via a video link to the trial of seven Kosovars suspected of involvement in the criminal network. Kosovo law forbids the removal and transplant of organs.

    Fain was shown photos of a building that he identified as the Medicus clinic in Pristina where he was driven for his kidney transplant in June 2008.

    The witness said he had been met in Istanbul, Turkey, by Israeli national Moshe Harel, who allegedly organized the transplant, and flown to Kosovo together with an elderly German man also seeking a kidney and two Russian women prepared to each donate one.

    Fain said the Russian women appeared between 30 and 40 years old and were busy shopping at the main airport in Istanbul. Upon arrival in Pristina, they were taken in separate cars to the clinic and into separate rooms, he said.

    "I was asked to shave and injected with what I believe was a form of anesthetic. After about 15 minutes I was wheeled into the operating room," Fain said. "I was kind of half asleep already, but I remember it was dark and it was cold. I was lying down on a very, very narrow bed."

    Harel and Turkish Dr. Yusuf Sonmez, who allegedly performed the operations, remain at large and are being sought by European Union prosecutors in charge of the case.

    Prosecutor Jonathan Ratel has said the Russian women were just two of some 20 foreign nationals "recruited with false promises of payments" in 2008.

    Victims were promised up to $20,000 (?15,100), while kidney recipients were required to pay between $105,000-$132,000 (?80,000 and ?100,000), according to Ratel.

    Fain testified Friday that Sonmez introduced himself before the operation and visited him every day while he was at the clinic, in the room he shared with a German man who also underwent an operation.

    "The discussion was about the state of my health. He said there were encouraging signs that the transplant was successful," Fain said.

    Fain spent five days recovering at the clinic before flying back to Canada. He said his recovery was "uneventful and faster than expected."

    He said he saw the two Russian women at the clinic but did not talk with them.

    "I encountered them in the hallway of the clinic. They appeared to be walking, like me," Fain said.

    Asked by the prosecution if he had received one of their kidneys, Fain said: "I believe so."

    The case began with indictments in November 2010, and the trial began last year. It is providing a stark look at a crime network that allegedly organized organ transplants and included criminals from countries such as Kosovo, Moldova, Ukraine, Turkey, Russia and Israel.

    Ratel said Fain's testimony helped "crystalize issues that have been outstanding for some time" by confirming the presence of Russian donors. He said Russian authorities were withholding evidence and access to crucial witnesses and at least three injured parties.

    "These three persons have been located, identified and provided statements to investigative authorities within the Russian Federation," Ratel said stressing that Russian authorities did not respond to requests for legal assistance from the EU rule of law mission in Kosovo.

    "A lot is said and a lot written ... All I have had through diplomatic channels has been definite silence," Ratel said.

    Russia does not recognize Kosovo's secession from Serbia, and Russian authorities are calling for an independent inquiry into allegations raised in a 2008 book by former U.N. war crimes prosecutor Carla Del Ponte that ethnic Albanian guerrillas killed Serb captives during the 1998-99 Kosovo war and sold their organs.

    The claims led to Council of Europe investigator Dick Marty write a report which said he is in possession of witness statements proving Kosovo Prime Minister Hashim Thaci and other citizens who once served as rebel commanders in the Kosovo Liberation Army had run detention centers on Albania's border with Kosovo where civilian captives, including Serbs, were killed and their organs sold on the black market during Kosovo's war for independence from Serbia.

    Thaci and Albania's government have denied those allegations.

    Ratel said Friday he will ask Marty to testify at the trial. Ratel is part of a 3,000-strong EU rule of law and police mission in Kosovo ? known as EULEX ? that deals with sensitive cases such as war crimes and organized crime.

    The allegations in the Marty report are being investigated by a special EULEX task force.

Undercover NYPD officers attended meetings of liberal political organizations and kept intelligence files on activists who planned protests around the country, according to interviews and documents that show how police have used counterterrorism tactics to monitor even lawful activities.

    The infiltration echoes the tactics the NYPD used in the run-up to New York's 2004 Republican National Convention, when police monitored church groups, anti-war organizations and environmental advocates nationwide. That effort was revealed by The New York Times in 2007 and in an ongoing federal civil rights lawsuit over how the NYPD treated convention protesters.

    Police said the pre-convention spying was necessary to prepare for the huge, raucous crowds that were headed to the city. But documents obtained by The Associated Press show that the police department's intelligence unit continued to keep close watch on political groups in 2008, long after the convention had passed.

    In April 2008, an undercover NYPD officer traveled to New Orleans to attend the People's Summit, a gathering of liberal groups organized around their shared opposition to U.S. economic policy and the effect of trade agreements between the U.S., Canada and Mexico.

    When the undercover effort was summarized for supervisors, it identified groups opposed to U.S. immigration policy, labor laws and racial profiling. Two activists ? Jordan Flaherty, a journalist, and Marisa Franco, a labor organizer for housekeepers and nannies ? were mentioned by name in one of the police intelligence reports obtained by the AP.

    "One workshop was led by Jordan Flaherty, former member of the International Solidarity Movement Chapter in New York City," officers wrote in an April 25, 2008, memo to David Cohen, the NYPD's top intelligence officer. "Mr. Flaherty is an editor and journalist of the Left Turn Magazine and was one of the main organizers of the conference. Mr. Flaherty held a discussion calling for the increase of the divestment campaign of Israel and mentioned two events related to Palestine."

    Police have good reason to want to know what to expect when protesters take to the streets. Many big cities, such as Seattle in 1999, Cincinnati in 2001 and Toledo in 2005, have seen protests turned into violent, destructive riots.     "Occupy Wall Street-type protesters mostly are engaged in constitutionally protected activity," department officials wrote in documents obtained under the Freedom of Information Act by the website Gawker. "We maintain our longstanding position that DHS should not report on activities when the basis for reporting is political speech."

    At the NYPD, the monitoring was carried out by the Intelligence Division, a squad that operates with nearly no outside oversight and is so secretive that police said even its organizational chart is too sensitive to publish. The division has been the subject of a series of Associated Press articles that illustrated how the NYPD monitored Muslim neighborhoods, catalogued people who prayed at mosques and eavesdropped on sermons.

    The AP left phone messages with Cohen and two NYPD press officers last week seeking comment about the undercover operation in New Orleans. They did not return the calls.

    The NYPD has defended its efforts, saying the threat of terrorism means officers cannot wait to open an investigation until a crime is committed. Under rules governing NYPD investigations, officers are allowed to go anywhere the public can go and can prepare reports for "operational planning."

    Flaherty, who also writes for The Huffington Post, said he was not an organizer of the summit, as police wrote in the NYPD report. He said the event described by police actually was a film festival in New Orleans that same week, suggesting that the undercover officer's duties were more widespread than described in the report.

    Flaherty said he recalls introducing a film about Palestinians but spoke only briefly and does not understand why that landed him a reference in police files.

    "The only threat was the threat of ideas," he said. "I think this idea of secret police following you around is terrifying. It really has an effect of spreading fear and squashing dissent."

    Before the terrorist attacks of September 2001, infiltrating political groups was one of the most tightly controlled powers the NYPD could use. Such investigations were restricted by a longstanding court order in a lawsuit over the NYPD's spying on protest groups in the 1960s.

    After the attacks, Cohen told a federal judge that, to keep the city safe, police must be allowed to open investigations before there's evidence of a crime. A federal judge agreed and relaxed the rules.

    Since then, police have monitored not only suspected terrorists but also entire Muslim neighborhoods, mosques, restaurants and law-abiding protesters.

    Keeping tabs on planned demonstrations is a key function of Cohen's division. Investigators with his Cyber Intelligence Unit monitor websites of activist groups, and undercover officers put themselves on email distribution lists for upcoming events. Plainclothes officers collect fliers on public demonstrations. Officers and informants infiltrate the groups and attend rallies, parades and marches.

    Intelligence analysts take all this information and distill it into summaries for Police Commissioner Raymond Kelly's daily briefing, documents show.

    The April 2008 memo offers an unusually candid view of how political monitoring fit into the NYPD's larger, post-9/11 intelligence mission. As the AP has reported previously, Cohen's unit has transformed the NYPD into one of the most aggressive domestic intelligence agencies in the United States, one that infiltrated Muslim student groups, monitored their websites and used informants as listening posts inside mosques.

    Along with the political monitoring, the document describes plans to use informants to monitor mosques for conversations about the imminent verdict in the trial of three NYPD officers charged in the 2006 shooting death of Sean Bell, an unarmed man who died in a hail of gunfire. Police were worried about how the black community, particularly the New Black Panther Party, would respond to the verdict, according to this and other documents obtained by the AP.

    The document also contained details of a whitewater rafting trip that an undercover officer attended with Muslim students from City College New York.

    "The group prayed at least four times a day, and much of the conversation was spent discussing Islam and was religious in nature," the report reads.

    Eugene Puryear, 26, an activist who attended the New Orleans summit, said he was not surprised to learn that police were monitoring it. He said it was entirely peaceful, a way to connect community organizers around the issues of racism and the rights of the poor. But he described it as a challenge to corporate power and said the NYPD probably felt threatened by it.

    "From their perspective, they need to spy on peaceful groups so they're not effective at putting out their peaceful message," he said. "They are threatened by anything challenging the status quo."

    Wounded Syrians recount horror of tank assaults

    Like most demonstrators in the crowd, Syrian university student Muaz Jaban was undaunted when soldiers began firing on their anti-government protest in his northern hometown of Ma'arra last week.

    Now lying in a Turkish hospital bed barely a kilometer from the Syrian border, the 22-year-old student of Arabic literature stares blankly at the bandaged stumps that were once his legs.

    "We saw the tanks pull into town. In front of them were soldiers. First, the soldiers started firing on the protesters, but we stayed where we were," said Jaban's uncle, who declined to give his name for fear of reprisals on family at home.

    "There was a high-ranking officer there with stars," he said, tapping his shoulder with three fingers. "He gave the order for the tanks to open fire."

    A tank fired one shell straight into the crowd killing three people and wounding at least 10, the uncle said. Jaban's left leg was severed near his pelvis and his right leg just below the knee.

    More than 8,000 killed
    Unable to mutter more than a few words, Jaban listens intently as his uncle retells his story. He grimaces as his uncle lifts the blanket to reveal what is left of his legs. Fluid weeps from his wounds and stains the bedsheet beneath him.

    Whether from the effects of the painkillers, shock or a mixture of both, Jaban's vacant gaze shows that reality has not yet sunk in. His trauma bears chilling testament to the increasingly violent nature of the conflict raging inside Syria.

    The year-long uprising against President Bashar al-Assad, which started as a peaceful protest movement, has drawn a brutal response from his security forces and there are now clashes on a daily basis around the country.

    The United Nations says more than 8,000 people have been killed so far and the toll is rising rapidly. Thousands more, like Jaban, have been wounded in the conflict which Damascus portrays as an insurrection by foreign-backed terrorists.

    The violence does come from both sides. Advocacy group Human Rights Watch on Tuesday condemned tactics of opposition fighters, saying rebels in Syria had kidnapped, tortured and executed security personnel and supporters of Assad.

    Jaban is one of scores of wounded Syrian civilians and rebel fighters being treated in Turkish hospitals in Hatay province along the Syrian border.

    Refugees sneak into Turkey day and night, scrambling through barbed wire fencing at unofficial border crossings. There are some 16,500 Syrian refugees now in Turkey with 200 to 300 people now crossing every day.

    Turkey has raised the possibility of creating a "buffer zone" inside Syria to protect the fleeing civilians, among options it could take if the stream of refugees turns into a flood.

    Jaban was taken to the Turkish border by rebel fighters, sometimes by vehicle, sometimes carried on a stretcher, to avoid the army checkpoints. He was finally passed through the barbed wire border fence on Sunday to a waiting Turkish ambulance.

    His uncle says Assad's forces are still occupying his hometown and the surrounding Idlib province, which borders Turkey.

    "The tanks are still there. Everyone is under fire," he said. As he speaks, Jaban slowly lifts his hand and pretends to pull a trigger with his finger as if to illustrate his uncle's point.

    Asked if he wants to say anything, Jaban shakes his head and points two of his fingers to form a victory sign, a trademark symbol of the Syrian uprising and other "Arab Spring" revolts.

    Fighter
    In the bed next to his, lies 36-year-old Mohammad. Unlike Jaban, Mohammad is a fighter in the Free Syrian Army, the ill-equipped opposition force battling Assad's military. He was wounded in a gun battle with Syrian troops in the city of Idlib a month ago.

    With his gaunt frame and bandaged body, Mohammad, who gave only one name, does not match the image of a fighter. He describes himself as a civilian who was just protecting his community.

    "The tanks started firing on the city at 5:30 in the morning. The roofs on the houses started to cave in. They did not stop firing until lunchtime," he said.

    "It was the same the next day but this time they continued until 7 p.m. On the second day, they entered the centre of the city. Whoever got in their way, they fired on them."

    Mohammad was shot twice in the abdomen and once in his right arm, shattering the bone. He received rudimentary treatment in Syria a month ago and was then smuggled into Turkey on Sunday, by fighters using blankets as a stretcher.

    But after he receives surgery on his arm and abdomen, Mohammad has no plans of staying in Turkey.

    "We don't want to stay here. I want to go back. As soon as I can, I will go back to Syria," he said.
